 Президент Украины Петр Порошенко подписал закон об особенностях осуществления правовых действий с государственным, гарантированным государством долгом и местным долгом (№2898).

По мнению правительства, право на мораторий не оказывает никакого отрицательного влияния ни на украинские банки, ни на валютообменный курс, а наоборот, будет иметь положительное влияние, потому что после этой операции долги Украины будут меньше.

Украина начала переговоры по реструктуризации части госдолга общим объемом 23 млрд долл. 13 марта – сразу же после одобрения программы кредитования экономики страны на 17,5 млрд долл. со стороны Международного валютного фонда. И хотя Украина пригласила Россию на переговоры по рефинансированию долга, РФ требует выплаты 3 млрд долл. в конце 2015 года, отказываясь от участия в реструктуризации.

Украинская делегация намерена в ходе весенней сессии Всемирного банка и МВФ в Вашингтоне 17 апреля представить кредиторам состояние долговой операции.

МВФ заявили, что Украина должна достичь соглашения о реструктуризации своей задолженности до того, как Международный валютный фонд пересмотрит свою программу помощи в июне.

Минфин Украины настаивает на необходимости достичь соглашения о реструктуризации в июне - до первого пересмотра программы МВФ, однако эксперты прогнозируют, что успехом будет реструктуризация долга и в начале осени этого года, а ее затягивание не приведет к прекращению финансирования по программе EFF.

Напомним, Кабинет министров Украины по предложению Министерства финансов 4 апреля утвердил перечень долговых обязательств для проведения реструктуризации. Соотношение государственного долга к ВВП не должно превысить отметку в 71% до 2020 года, а долговое финансирование бюджета - не более 10% ВВП. Реструктуризация коснется внешних долгов, возникших до 28 февраля 2014 года, и будет включать часть внешнего долга Украины, гарантированные государством внешние долги и квазисуверенные долги - еврооблигации государственных банков, Укрзализныци, города Киева.

Отметим, что мораторий на выплаты по внешним долгам – это не объявление дефолта, а разделение ответственности между парламентом и правительством. Об этом заявил член Национального совета реформ, основатель общественной организации "Easy Business", президент Гарвардского клуба Украины Даниил Пасько, передает 112.ua.

"Украина не объявила дефолт. Заявление Путина о том, что Украина фактически что-то объявила, не соответствует действительности. На сегодня парламент дал право правительству не выплачивать часть долга. Это не значит, что он не будет выплачен, это лишь разделение ответственности между парламентом и правительством. Это важный шаг для того, чтобы ответственность за это решение лежало не только на премьер-министре, но и на парламенте, и это логично в парламентской республике, каковой является Украина, поэтому дефолт мы не объявили", - сказал Пасько.

Принятый Верховной Радой Украины законопроект, который предоставляет Кабинету Министров Украины право приостанавливать платежи по внешним долговым обязательствам, станет дополнительным аргументом в переговорах с кредиторами о более выгодных условиях реструктуризации внешнего долга Украины. Такое мнение высказал основатель и генеральный директор инвестиционной компании Dragon Capital Томаш Фиала в комментарии изданию "ГОРДОН".

"Мораторий (…) даст больше аргументов Минфину в попытках договориться с частными кредиторами о реструктуризации долга, в том числе и с Россией. Это такой дополнительный аргумент, потому что переговоры между Минфином и частными кредиторами зашли в тупик. Это дополнительный аргумент, чтобы надавить на частных кредиторов и заставить их договориться", – заявил эксперт.

По мнению Фиалы, инициатива правительства о возможности введения моратория на выплаты по внешним долгам, одобренная парламентом, обеспечивает более широкую политическую поддержку и консенсус в процессе урегулирования долговых отношений с кредиторами.

Глава Dragon Capital исключает введение моратория в ближайшие месяц–полтора, до принятия решения Международным валютным фондом (МВФ) о предоставлении второго транша Украине.

"Если до конца июня не получится договориться (с кредиторами), возможно, мораторий будет применен в июле-августе, чтобы увеличить давление (на кредиторов) и договориться до двадцатых чисел сентября, когда нужно будет погашать самый ближайший евробонд (еврооблигации с ближайшим сроком погашения)", – пояснил эксперт.

Фиала напомнил, что в переговорах с держателями украинских обязательств Министерство финансов Украины добивается списания как минимум 20% тела долга.
Оценочная стоимость активов неплатежеспособных банков составляет 46 млрд грн, при том, что балансовая стоимость активов этих банков составляет 287 млрд грн.
